Welcome to Tendy! These Terms of Service ("Terms") govern your use of the services provided by Tendy, Inc. (“Tendy”, “we”, “us”, or “our”), including our website, mobile application, and payment services (collectively, the “Services”).

By creating an account or using our Services, you agree to these Terms and our Privacy Policy.

1. Eligibility and Account Creation

You must be at least 18 years old (or the age of majority in your state) and reside in the United States to use Tendy. By signing up, you agree that the information you provide is accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials. You agree not to impersonate any person or entity or use false information.

2. Services Provided

Tendy allows users to send, receive, and manage payments, including peer-to-peer transfers and commercial transactions. We may offer additional features from time to time.

We are not a bank or a money transmitter. Funds held in your Tendy account are not FDIC insured.

Tendy may charge fees for certain transactions, including instant transfers or business-related payments. These will be disclosed prior to completing a transaction.

5. Payment Authorization

By initiating a payment, you authorize us to debit your linked bank account, debit card, or balance. You agree that you have sufficient funds to complete the transaction.

6. Transaction Limits and Holds

We may impose limits on your transactions or place holds on funds to reduce risk. These limits may change based on account activity and verification status.

7. Refunds and Disputes

Refunds may be requested for unsent balances by contacting hello@tendy.cash. Refunds are not available once payments have been sent.

In certain situations, withdrawals may be processed as refunds to the original deposit method. This is for fraud prevention and anti-money laundering purposes.

You are responsible for resolving any disputes with other users. Tendy may assist in certain cases, but we do not guarantee dispute resolution.

8. Identity Verification

You agree to provide information necessary to verify your identity, including government-issued ID, social security number, and other documentation.

We may use third-party services to complete these checks.

9. Account Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, for any violation of these Terms, suspected fraud, or legal requirements.

You may close your account at any time, subject to resolving any outstanding obligations.

10. Limitation of Liability

Tendy is not liable for indirect, incidental, or consequential damages. Our liability is limited to the amount of fees you paid us in the 12 months preceding the incident.

11. Dispute Resolution and Arbitration
